Sole parental responsibility

Sole custody agreements are child custody agreements that in nature are filled with emotion. Facing a future of caring for your children on your own is frightening. Sole custody refers to the child custody agreement where one parent has physical and legal custody of the children. This isn’t as common as it once was and is only ever utilized under a few circumstances:

  • One parent has given up their parental rights
  • One parent is incapable of custody, for example, incarcerated
  • One parent has a history of domestic or child abuse
  • Both parents are not capable of caring for the child, for example, a grandparent is granted sole custody
