About Child Visitation, Time Sharing and Parenting Plans in Florida
Child visitation can be an emotional, and sometimes contentious issue between divorcing or divorced spouses. The prospect of no longer living with child/children or potentially losing the close-knit relationship a parent has with their offspring can be distressing.
Visitation rights (time sharing) allow the parent without physical custody of the child to spend reasonable time with their child. The time-sharing schedules can be determined by the court or the parents may agree on it between themselves. Typically there is a formal legal agreement but not always. When there is an agreement or time-sharing (visitation) is court mandated, a modification of the schedule or plan typically is required to be submitted to, and approved by, the court. Similarly, should a parent feel they are being denied reasonable visitation rights and parenting time, then legal recourse may be required by each parent, one to pursue their rights, one to defend or rebut the denial. Additionally, in situations where the court deems visitation to be detrimental or not in the child’s best interest or for non-payment of child support, time-sharing/visitation can be denied.
